1. Introduction

Welcome to UTECH (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our website (https://utechksa.com) and the purchase of industrial engineering products, machinery, and production lines (“Products”) from our digital store.

By placing an order or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services. These Terms constitute a legally binding agreement between you and UTECH, governed by the laws of the Kingdom of Saudi Arabia.

2. Definitions

  • “Customer”: Any individual, company, or entity that purchases Products from UTECH.
  • “Products”: Industrial machinery, packaging systems, spare parts, inks, and consumables listed on our website.
  • “Special Order”: Customized machinery or production lines manufactured specifically for the Customer’s requirements.

3. Account Registration

To make a purchase, you may be required to register an account. You agree to:

  1. Provide accurate, current, and complete information (including National Address and Commercial Registration if applicable).
  2. Maintain the security of your password and identification.
  3. Accept responsibility for all activities that occur under your account.

4. Pricing and Payment

  • Currency: All prices are displayed in Saudi Riyals (SAR).
  • VAT: All prices are subject to Value Added Tax (VAT) at the prevailing rate of 15% in accordance with ZATCA regulations, unless explicitly stated otherwise.
  • Payment Methods: We accept payments via:
    • Mada, Visa, MasterCard (processed securely via EdfaPay).
    • Buy Now, Pay Later services (Tamara) subject to their respective terms.
    • Direct Bank Transfer (Orders are processed only after funds clear).

5. Shipping and Delivery

  • Logistics Partners: We ship using authorized carriers including SMSA.
  • Delivery Timelines:
    • In-Stock Items (Spare Parts/Consumables): Typically 2-5 business days within major Saudi cities.
    • Machinery & Heavy Equipment: Delivery timelines will be communicated upon order confirmation.
  • Shipping Costs: Calculated at checkout based on weight and destination.
  • Risk of Loss: Responsibility for the Products passes to the Customer upon delivery to the carrier. However, we insure shipments against damage during transit.

6. Warranty Policy

  • Industrial Machinery: Most machinery sold by UTECH comes with a manufacturer’s warranty (typically 1 year) covering defects in materials and workmanship. This does not cover damage caused by misuse, lack of maintenance, or unauthorized modifications.
  • Spare Parts & Consumables: Sold “as is” without warranty unless explicitly stated otherwise due to the nature of wear-and-tear components.
  • Service: Warranty claims must be submitted via our Support Ticket system.

7. Returns and Cancellations

  • Standard Returns: Unopened, unused spare parts may be returned within 7 days of receipt, subject to a restocking fee (typically 15-20%) and return shipping costs.
  • Non-Returnable Items:
    • Customized machinery or “Special Orders.”
    • Consumables (Inks, Solvents) that have been opened or unsealed.
    • Electrical components once installed.
  • Defective Items: If a Product arrives defective, you must notify us within 3 days of delivery for a replacement or repair assessment.

8. Limitation of Liability

To the maximum extent permitted by Saudi law:

  • UTECH shall not be liable for any indirect, incidental, or consequential damages (including lost profits or production downtime) arising from the use or inability to use our Products.
  • Our total liability shall not exceed the amount actually paid by you for the Product giving rise to the claim.

9. Intellectual Property

All content on this website, including text, logos, technical specifications, and images, is the property of UTECH or its suppliers and is protected by Saudi and international copyright laws.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Jeddah, Saudi Arabia.
